Instructions on withdrawal for consumers

Applies to brokerage contracts with AviScout GmbH & Co. KG concluded with consumers by means of distance communication (e.g. by e-mail, telephone, WhatsApp).

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of conclusion of the contract.

To exercise your right of withdrawal you must inform us — AviScout GmbH & Co. KG, Heinrich-Kappus-Weg 17, 61440 Oberursel (Taunus), Germany, telephone +49 6171 8986 483, e-mail mail@aviscout.com — by means of a clear statement (e.g. a letter sent by post or an e-mail) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, although it is not obligatory.

To meet the withdrawal deadline it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

If you withdraw from this contract, we must reimburse to you all payments received from you without undue delay and no later than fourteen days from the day on which we receive notice of your withdrawal from this contract. We will use the same means of payment as you used for the initial transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of such reimbursement.

If you requested that the service should begin during the withdrawal period, you must pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

In the case of a contract for the provision of services, your right of withdrawal expires if we have fully performed the service and only began performance after you gave your express consent and at the same time confirmed your awareness that you lose your right of withdrawal upon complete performance of the contract by us.

The right of withdrawal relates exclusively to the brokerage contract with AviScout, not to the brokered charter contract with the airline. A charter contract already concluded is not affected by withdrawal from the brokerage contract; the cancellation conditions of clause 8 of our General Terms and Conditions apply to it.

Where the order is placed via an activated messenger channel pursuant to clause 3.5 of the General Terms and Conditions, the declaration on early commencement must be transmitted as a separate message. It reads:

„I expressly request that AviScout begin the brokerage service before expiry of the withdrawal period. I am aware that my right of withdrawal expires upon complete performance of the brokerage service.“
